HED 6501: The Law and Higher Education: Assignment 4

The following will be included in our next class discussion on institutional tort liability in Higher Education. 

1. Read Sources and Scope of Authority and Liability (Section 3.2, 171-188) and Institutional Tort Liability (Section 3.3, 189-224) in your textbook: Kaplin, W.A & Lee, B.A. (2007). The Law of Higher Education. San Francisco: Jossey-Bass. (Be prepared to discuss the material covered.)
   

2. Each of you is assigned two cases (see below).  Read these cases carefully and become familiar with their facts, legal issues, decisions, etc. You will be asked to give an overview of your assigned cases as part of our class discussion, so be prepared to do so.
   

3. Select one of the two cases you have been assigned and prepare a legal brief on that case.  You brief will be turned in at the end of each class.  
   

NOTE:  If students are unable to attend class, all briefs and other written assignments are expected to be sent to me electronically (stanford@mc.edu) on the date that they are due (or turned in by a classmate).
